KUBBY SEEKS IMPLEMENTATION OF PROP. 215 IN ORANGE COUNTY
ORANGE COUNTY, CA. Steve Kubby, who played a key role in the passage of Prop. 215 and
an outspoken advocated of medical marijuana has a new goal on his busy political agenda:
Implementing Californias medical marijuana law in conservative Orange County.
The former gubernatorial candidate, who is now facing 19 charges with his wife for
growing his own medicine in Placer County says the mood is much healthier in Orange County
where a new District Attorney and Sheriff have already shown a willingness to recognize
the new medical marijuana law.
Kubby has been meeting with community leaders to discuss the Oakland ordinance and how
the successful new ordinance is working so smoothly that even the Oakland police support
it.
Another concern that Kubby is discussing with community leaders is, "the bullying
attitude of the Drug Czar, an un-elected, non-accountable official, who continues to
violate California law by threatening patients, doctors and their elected officials."
"I intend to convince Orange County officials that they are not at risk of legal
actions against them or patients by the Attorney General or the Feds. Attorney General
Lockyer has already gone on record that he wont interfere with local plans for
implementation. As for the Feds, the DEA in California has historically refused to
prosecute cases involving less than 400 plants, far below the 144 plants allowed by the
Oakland ordinance," says Kubby.
"O.C. officials will receive great media coverage for finding a successful means
for implementing the Compassionate Use Act. No county has found a way to implement our two
year old medical marijuana law and O.C. officials would gain national headlines as the
first."
According to Kubby, implementation of the Compassionate Use Act is best done at the
county level, since the county health department can issue its own, secure patient IDs.
"Health Department IDs, if done properly, will not violate patient confidentiality or
expose them to criminal investigation. At the same time, these official health department
IDs would protect police by providing for easy identification of legal patients."
Kubby says he is looking forward to working with officials to find a legal and humane
plan for allowing other patients such as himself to grow their own medicine, under the
strict guidelines of an Orange County law similar to the Oakland ordinance.
Bill Lockyer the new Attorney General who was elected partly on his promise to
implement Prop. 215, says his hands are tied until the Feds reschedule marijuana, but
Kubby disagrees.
"The California Constitution is very clear on this.
According to Article III Section 3.5, an administrative agency has no power to declare a
statute unenforceable or to refuse to enforce a statute on the basis that federal law or
federal regulations prohibit the enforcement of such statute unless an appellate court has
made a determination. No such determination has been made, or even sought for our new
medical marijuana law, so no one can legally argue that they cannot enforce Health and
Safety Code 11362.5 because of Federal law."

While Democrats and Republicans fight to outspend each other supporting the War on
Drugs, the Libertarian Party is firmly opposing the War and supporting those on the front
lines.
The Libertarian Party certainly has stood by us in our time of need. My wife Michele
and I are medical marijuana patients and played a key role in the passage of Prop. 215,
the medical marijuana initiative. We were following the same law we helped pass when we
were raided by a SWAT team and dragged off to jail.
After our illegal arrest, the authorities issued damning statements which described us
major drug dealers. Instead of abandoning us as politically incorrect, the Libertarian
Party rushed to our support and publicly blasted the authorities for their illegal
actions.
Within a few weeks, thousands of dollars arrived in our mail box. Nearly all of those
contributions were from big L Libertarians, i.e. card carrying members of the
Libertarian Party.
Today, we are preparing for the battle of our lives, thankful that we belong to a
political party that stands by their own. In a time when politics has become so sleazy,
its refreshing to know that the Libertarians can be counted on when the going gets
rough.
Some have told us that the Libertarian Party isnt big enough to be viable in
politics. Well, as Tip ONeil once observed, "Politics is local." For us,
after being robbed at gunpoint and then thrown in jail, its as political and as
local as it gets. We are grateful that the party we chose to support has not hesitated to
support us and medical marijuana.
The Libertarian Party may not be the biggest or the most powerful, but its a
great group of folks who are there when you need them.
