In Hebrew, Hanukkah means Dedication. That is what We the People are all about-- Dedication to Equal Justice under the Law. Hanukkah is celebrated as both the Festival of Dedication and the Festival of Lights and commemorates the victory of the Maccabees over the oppressors in 165 B.C.E. and the re-dedication of the Temple in Jerusalem which had been defiled by them. Each night of the festival an additional candle is lit until on the last night, eight candles are burning. According to tradition, when the Temple was re-captured, only one small vessel of consecrated oil - enough for just one day - was found. Miraculously, it sufficed for eight days until new oil could be prepared and the festival was established for this length of time to commemorate the miracle.

This holiday honors both the struggle and victory over oppression - victory achieved by moral courage, endurance and the power of Light. Light and Truth will always vanquish darkness and dishonesty.

Shadows are simply appearances, which show that the source of illumination – the Light is being blocked. Don’t be frightened by the shadows.

Strangely, on December 1, 1999, Judge Katz slipped into the shadowy world of total inter-governmental conspiracy, dishonesty and cover-up. Prior to the court’s adjudication on the government’s motion for summary judgment, we filed opposition papers centered on a comprehensive, compelling Affidavit of our lead plaintiff Kiyoshi Kuromiya, who presented his duly sworn testimony, in proper legal form, as both a non-expert and an expert, in opposition to a legally flawed and wholly defective non-conforming government motion. Each of you is encouraged to study Kiyoshi’s Affidavit.

The Affidavit in its entirety will be made available to you initially over the Internet. You will be educated, and inspired by this work.

Kiysohi’s Affidavit was totally ignored by the court. The court ignored all of our multi-pronged, meritorious legal arguments. The court ignored volumes of documentation that we placed on the record. That documentation clearly demonstrates, as a matter of law, that dismissing the plaintiff’s Complaint with no trial, nor any opportunity to present testimony is grievous reversible error. In sum, the Action Class was unjustly denied its day in court without due process of law.

The court completely ignored our "class action". The only thing the court did not ignore was the government’s stonewall position, which the court rubberstamped as if the process of judicial review was the same as a computerized device reading the electromagnetic bar code on a product at your local supermarket. We were robbed. We were shortchanged. And, we got no customer service. All because… we were the vessel from which the Truth and the Light were emerging.

By formal, written motion for reconsideration, we will ask the court to correct its numerous, manifest errors of law and fact. By separate action, we will seek relief from the injustice of the dismissal of the class action under Federal Rule 60(b)(3), which provides specifically for relief from any judgment procured by "fraud " "misrepresentation," and "other misconduct of an adverse party."

The trial court’s adverse decision is of no true legal significance. Each one of us deals with and overcomes more adversity in life everyday than the adversity of this judicial aberration. We have learned much in the last year and a half. The Action Class now has a life of its own. It has structure, power, strength, brains, heart and soul. And, we’re making new friends and creating new alliances, from all communities, all the time. The best has yet to come. We shall finish this century strong, and start 2000 even stronger. I will be sending you a detailed status report and agenda for future actions very shortly.
